Terms of service

1. Who these are with

These terms are between you and Glide Marketing Ltd, registered in England and Wales (company 15154178), which operates QuotePack. Using QuotePack means accepting them.

2. What QuotePack does

QuotePack helps you produce a quote, send your client a link to it, see when they open it, and record their acceptance. It calculates totals, VAT and deposits from the figures you enter.

QuotePack does not handle the money between you and your client. Whether they pay by bank transfer, through your own payment link, or by card once that is available, the money goes from them to you. We are not a party to it, we do not hold it, and we take no share of it.

3. What it costs

QuotePack is currently free while it is being developed. We may introduce charges. If we do:

• We will tell you by email before it happens.
• Quotes you have already sent will keep working. We will not take a live quote away from your client because of a change to our pricing.
• You will never be charged without agreeing to it first.

4. Your account and your links

A quote is reached by an unguessable link, and whoever holds that link can see the quote. That is deliberate: it means your client can read and accept it without an account. It also means the link is a credential, and you should treat it like one.

We store only a hash of each link, so we cannot recover one for you. If you lose it, sign in and find the quote on your dashboard.

5. What you are responsible for

• The contents of your quotes. The prices, the scope, the terms and the promises are yours. We do not check them.
• Your VAT position. We calculate VAT from what you tell us about your registration and your prices. Whether you should be charging it is between you and HMRC.
• Having the right to enter your client’s details. You are the controller of that data. See section 9.
• Your contract with your client. A quote accepted through QuotePack forms an agreement between the two of you. We are not a party to it and cannot resolve a dispute about it.

6. What we are responsible for

• Calculating correctly. Every total, tax figure and deposit is computed on our servers in whole pence. If a figure is wrong because of a defect in our calculation, tell us and we will fix it and tell you which quotes were affected.
• Keeping your quotes private. No quote is ever indexed by a search engine or shown to anyone without its link.
• Providing the service with reasonable care and skill, as the law requires.

7. What we cannot promise

The service is provided as it is. We do not guarantee it will be uninterrupted or error free, and we do not guarantee that using it will win you work.

We do not guarantee delivery of email to your client’s inbox. Email delivery depends on their mail provider, not on us.

8. Liability

Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, and because QuotePack is currently provided free of charge: our total liability to you for any claim is limited to the greater of the amount you have paid us in the previous twelve months, or £100.

We are not liable for loss of profit, loss of business, loss of anticipated savings, or for a contract you did or did not win.

If you are a consumer rather than a business, your statutory rights are unaffected by anything in this section.

9. Your clients’ data

This section is a data processing agreement between us, and it applies whenever you enter a client’s personal data into QuotePack.

• You are the controller. We are the processor. You decide what to collect and why; we hold it on your behalf.
• We process it only on your instructions, which means only to provide the service described in these terms.
• We keep it secure, with the measures described in our privacy policy and on our security page.
• We use sub-processors, listed in the privacy policy. We will tell you before adding one.
• We help you meet your obligations: if your client asks for their data, or asks for it to be deleted, tell us and we will act.
• We tell you about a breach without undue delay if one affects data you control.
• We delete or return it when you stop using the service, subject to the retention periods in the privacy policy.

10. Aggregate data

We may use anonymised, aggregated information about quotes to understand what UK small businesses charge and to publish benchmarks. No figure is published from fewer than 50 jobs, nobody is identifiable, and you can opt out at any time by writing to us. This is set out in full in the privacy policy.

11. Acceptable use

Do not use QuotePack to:

• Send anything unlawful, fraudulent or deliberately misleading
• Quote for goods or services you cannot lawfully supply
• Send unsolicited bulk messages
• Attempt to access quotes that are not yours, or to enumerate links
• Interfere with the service or its security

We may suspend or end access for a serious or repeated breach. Where we can, we will tell you first.

12. Ending it

You can stop using QuotePack at any time and ask us to delete your data. We may end this agreement by giving you 30 days’ notice, and will give you a way to export your quotes before we do.

13. Changes

We may change these terms. If a change is material we will tell account holders by email at least 14 days before it takes effect. Continuing to use QuotePack after that means accepting the change.

14. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
